SupNoke™ Terms of Use

Your agreement with SupNoke™

Section 10 (Promotions): added Responsible Party clauses (member-gated prize fulfillment, indemnification, 30-day fulfillment window) and tax-reporting cooperation language. Section 6 (Location Data): clarified that raw GPS coordinates are not retained — only the verified-distance signal and check-in record persist.

1. Acceptance of Terms

By accessing or using SupNoke (the “Service”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, you may not access or use the Service.

SupNoke is operated by Harmonic Lift, LLC (“we,” “us,” or “our”).

2. Description of Service

SupNoke is an event discovery and engagement platform that allows users to browse events, check in to events, and participate in platform features tied to local experiences.

The Service may change from time to time as features are added, modified, or removed.

3. Eligibility

You must be at least 18 years of age to use SupNoke. By using the Service, you represent and warrant that you meet this requirement and that all information you provide is accurate and truthful.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or misuse the Service.

5. Event Information Disclaimer

SupNoke aggregates event information from third-party sources. We do not guarantee the accuracy, completeness, or availability of any event listing.

Event details, times, locations, and availability are subject to change without notice, and SupNoke is not responsible for cancellations, errors, or inaccuracies.

6. Location Data and Check-Ins

Certain features of SupNoke, including event check-ins, promotions, and giveaway eligibility verification, require limited location-related information.

When a user initiates a check-in:

  • •Location information is used solely to verify physical presence near the applicable event location;
  • •Verification is performed using geofence proximity and device-reported accuracy signals;
  • •Raw GPS coordinates are not retained following the verification process.

SupNoke retains:

  • •The successful check-in record;
  • •The verified-distance or eligibility verification result;
  • •Related anti-fraud and audit information reasonably necessary to operate the Service, enforce platform rules, and administer Promotions.

Location-related information is collected only when users actively use features requiring verification and is not used for continuous background tracking or sold to third parties for advertising purposes. See our Privacy Policy for additional details on how data is handled.

7. Acceptable Use

You agree not to:

  • •Attempt to spoof or falsify location data
  • •Use automated tools, scripts, or bots
  • •Manipulate promotions or giveaways
  • •Interfere with the operation of the Service
  • •Violate any applicable laws or regulations

Violation of these rules may result in suspension or termination of your account.

8. Changes to These Terms

We may update or modify these Terms from time to time to reflect changes in our services, features, pricing, legal requirements, or business practices.

When changes are made:

  • •The “Last Updated” date at the top of these Terms will be revised.
  • •Material changes may be communicated through the SupNoke platform or other reasonable means.

Continued access to or use of SupNoke after any changes become effective constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must discontinue use of the Service.

9. Limitation of Liability

To the maximum extent permitted by law, Harmonic Lift, LLC and SupNoke shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of the Service.

Your sole remedy for dissatisfaction with the Service is to discontinue use.

10. Promotions, Giveaways, and Check-In Rewards

SupNoke may offer promotions, giveaways, contests, or sweepstakes (collectively, “Promotions”) that are linked to event check-ins or other platform activity.

Eligibility

Promotions are open only to users who:

  • •Are at least 18 years of age
  • •Are legal residents of the United States, unless otherwise stated
  • •Have an active SupNoke account in good standing
  • •Are physically present at the applicable event location, as verified by GPS-based geofencing

Employees, contractors, and affiliates of Harmonic Lift, LLC and their immediate family members are not eligible unless expressly stated otherwise.

No Purchase Necessary

No purchase or payment is required to enter or win any Promotion. Making a purchase will not increase the chances of winning.

Entry Conditions

  • •One entry per user per Promotion
  • •Automated, fraudulent, or abusive entries are prohibited
  • •SupNoke reserves the right to verify eligibility and compliance

Winner Selection and Notification

  • •Winners are selected at random
  • •Odds of winning depend on the number of eligible entries
  • •Winners are notified via the email address associated with their SupNoke account
  • •Promotion results are final and irreversible once executed

Failure to respond to a prize notification within the specified time may result in forfeiture.

Prizes

  • •Prizes may include items of monetary value such as gift cards, merchandise, tickets, or experiences
  • •Prizes are awarded “as-is”
  • •No cash alternative, substitution, or transfer is permitted unless explicitly stated
  • •SupNoke is not responsible for lost, damaged, delayed, or unusable prizes

Responsible Parties and Prize Fulfillment

Certain Promotions may designate a SupNoke member or organization as the party responsible for prize fulfillment (“Responsible Party”). Responsible Parties must maintain a SupNoke account in good standing in order to participate in or administer Promotions.

By accepting these Terms and participating as a Responsible Party, the Responsible Party agrees to:

  • •Timely coordinate and fulfill all awarded prizes;
  • •Provide prizes substantially as described in the applicable Promotion;
  • •Comply with all applicable laws and regulations relating to prize fulfillment and taxation; and
  • •Cooperate with reasonable requests from SupNoke relating to winner verification, fulfillment tracking, or tax reporting obligations.

Unless otherwise stated in the applicable Promotion, Responsible Parties are expected to initiate reasonable fulfillment efforts within thirty (30) days of the applicable draw date.

Responsible Parties further agree to indemnify, defend, and hold harmless Harmonic Lift, LLC, SupNoke, and their officers, members, employees, contractors, and affiliates from and against any claims, disputes, damages, liabilities, costs, or expenses arising from:

  • •Failure to fulfill a prize;
  • •Delayed fulfillment;
  • •Defective, unsafe, unlawful, or materially misrepresented prizes;
  • •Violations of applicable laws or regulations relating to the Promotion or prize fulfillment.

SupNoke reserves the right, but not the obligation, to assist in communication or coordination between winners and Responsible Parties. SupNoke is not responsible for the acts, omissions, products, services, or fulfillment performance of Responsible Parties.

Tax Reporting Cooperation

Winners are solely responsible for any applicable federal, state, or local taxes. Winners may be required to provide tax documentation, including IRS Form W-9, where required by applicable law or reporting thresholds. SupNoke and/or the applicable Responsible Party may report prize values to tax authorities in accordance with applicable federal, state, or local requirements.

Liability Release

By participating in any Promotion, entrants agree to release and hold harmless Harmonic Lift, LLC, SupNoke, and their officers, members, employees, contractors, and partners from any claims arising from participation, prize acceptance, or use.

Fraud and Disqualification

SupNoke reserves the right to disqualify any participant who violates these Terms or engages in fraud, abuse, manipulation, or circumvention of platform safeguards.

Modification or Cancellation

SupNoke reserves the right to modify, suspend, or cancel any Promotion at any time for any reason, including technical issues or suspected abuse.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to conflict of law principles.
